  1. This document is an electronic record in terms of the Information Technology Act, 2000, and the rules made thereunder. It is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which require the publication of rules and regulations, privacy policy, and terms of use for access or usage of this website, (hereinafter referred to as the “Platform”).
  2. This electronic record is generated by a computer system and does not require any physical or digital signatures.
  3. The Platform is owned, operated, and managed by Amara, a brand founded and managed by Anu Scaria, with offices in Kochi and Changanassery, Kerala, India (hereinafter collectively referred to as the “Company”, “We”, “Us”, or “Our”).
  4. By accessing, visiting, or using this Platform, you (“User”, “You”, or “Your”) acknowledge that you have read, understood, and agree to be lawfully bound by these Terms and Conditions (“Terms of Use”).
  5. Except as otherwise specified, these Terms do not apply to third-party services or websites, which shall be governed by their own respective terms and policies.

     

  6. 1. TERMS

  7. 1.1 By using or accessing this Platform, you are deemed to have accepted these Terms of Use. We reserve the right, at our sole discretion, to modify, amend, or update these Terms from time to time without prior notice.
  8. 1.2 These Terms constitute a legally binding agreement between You (the User) and Amara.
  9. 1.3 A “User” shall mean any individual who visits, accesses, or transacts on this Platform, including those who purchase products, browse content, or communicate with us through the site.
  10. 1.4 By impliedly or expressly accepting these Terms, you also agree to be bound by our Privacy Policy, Shipping & Delivery Policy, and Return & Cancellation Policy, as may be updated and made available on this Platform.
  11. 1.5 If you do not agree to these Terms, you are expressly prohibited from using the Platform and must discontinue use immediately.
  12. 1.6 We do not permit minors (persons below the age of 18 years) to use the Platform without the consent or supervision of a parent or legal guardian.

     

  13. 2. USER REPRESENTATIONS

  14. 2.1 You confirm that you are at least 18 years old and competent to contract under applicable laws.
  15. 2.2 You agree to provide true, accurate, and complete information whenever requested on the Platform (for example, during checkout or contact form submission).
  16. 2.3 You are solely responsible for maintaining the confidentiality of your personal and account information and for all activities that occur under your account.
  17. 2.4 You agree not to use the Platform for any unlawful or unauthorized purpose, nor attempt to modify, hack, or interfere with the Platform’s functionality.

    3. PERSONAL DATA

  18. 3.1 We collect and process your personal data, including name, contact details, billing/shipping address, and payment information, in accordance with our Privacy Policy.
  19. 3.2 By using the Platform, you consent to our collection, use, and sharing of your personal data with trusted service providers (such as payment gateways and courier partners) solely for the purpose of fulfilling your orders and improving our services.

  23. 4. REPRESENTATION AND WARRANTIES

  24. 4.1 The Platform and all products or services available herein are provided on an “as is” and “as available” basis. You agree that your use of the Platform is at your sole risk.
  25. 4.2 We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of any information, product, or service offered on the Platform.
  26. 4.3 We shall not be liable for:
    i. Any personal injury, property damage, or loss resulting from your access or use of the Platform or the products purchased;
    ii. Any unauthorized access to or use of your personal or financial information;
    iii. Any delays, interruptions, or errors caused by external factors such as courier services or third-party systems;
    iv. Any content errors or omissions, or for any loss arising from the use of such content.
  27. 4.4 We have established a proper grievance redressal mechanism. Any customer grievances may be raised to our team via email at anuskaria99@gmail.com, and we will acknowledge your complaint within 48 hours and resolve it within 30 days of receipt.

     

  28. 5. ORDERS, SHIPPING & DELIVERY

  29. 5.1 Orders are processed within 1–2 business days after payment confirmation.
    5.2 Custom-made or pre-order items may require additional processing time.
    5.3 Domestic deliveries typically take 2–3 business days post dispatch.
    5.4 Shipping costs are calculated at checkout based on destination and weight.
    5.5 Once dispatched, tracking details are shared via email or WhatsApp.
    5.6 We are not responsible for courier delays or circumstances beyond our control.
    5.7 Users are responsible for providing an accurate and complete shipping address.

     

  30. 6. RETURNS & CANCELLATIONS

  31. 6.1 Returns or exchanges are accepted only for defective, damaged, or incorrect products.
    6.2 Customers must contact us within 48 hours of receiving the order and share clear images of the issue.
    6.3 Returned products must be unused, unwashed, and in original packaging.
    6.4 Non-returnable items include custom-made, altered, or sale products.
    6.5 Orders may be cancelled within 12 hours of placement, provided they have not been processed or dispatched.
    6.6 Refunds, if approved, will be processed within 7–10 business days to the original payment method.

     

  32. 7. INTELLECTUAL PROPERTY

  33. 7.1 All content on the Platform—including logos, designs, photographs, videos, and text—is the exclusive property of Amara by Anu Scaria.
    7.2 Reproduction, distribution, or modification of any material without written permission is strictly prohibited.

     

  34. 8. LIMITATION OF LIABILITY

  35. 8.1 Amara shall not be held liable for any indirect, incidental, or consequential damages arising out of or related to your use of the Platform or products purchased.
    8.2 We are not responsible for damages or losses once an order has been handed over to the courier partner.

     

  36. 9. GOVERNING LAW & JURISDICTION

  37. 9.1 These Terms are governed by and construed in accordance with the laws of India.
    9.2 All disputes are subject to the exclusive jurisdiction of the courts in Kochi, Kerala.
